2. Scope

2.1. The Affection Outdoor Festival takes place on a designated festival site in Hünxe (North Rhine-Westphalia). The festival area includes the event area, the camping grounds and the parking areas (hereinafter referred to as "festival grounds").

2.2. These General Terms and Conditions (hereinafter referred to as the "Terms") apply between the visitor and the organizer. The General Terms and Conditions shall be deemed applicable by the visitor prior to the purchase of a ticket and / or product or service. The terms and conditions apply even if the ticket was purchased by a third party regardless of the way. By purchasing a ticket, the visitor concludes an event contract with the organizer. By booking a parking space, the visitor concludes a rental agreement for a car parking space.

2.3. The German language is negotiated and contracted language. For all foreign business, the following terms and conditions apply as well, unless otherwise stipulated in our terms and conditions for the respective countries.

3. Prohibition of sale / prohibition of modification of tickets / contractual penalty

3.1. The organizer agrees in principle to the transfer of the visitation right to a third party, unless

3.1.1. against the third is a house ban.

3.1.2. The visitation rights are offered at a higher price than for the nominal price of the ticket.

3.1.3. the sale is mediated by unauthorized third parties, in particular Internet service providers.

3.2. Any commercial resale / distribution of the purchased tickets without the prior consent of the organizer is prohibited.

3.3. The preparation of the ticket (for example, printing, modifying or otherwise changing the ticket) for the purpose of deceiving or disadvantaging others is prohibited.

3.4. Any visitor who passes on tickets in violation of the above conditions of approval or who prepares them in accordance with Section 3.2 pays the organizer a reasonable contractual penalty of € 2,500 per ticket or contracted visit.

3.5. If the visitor does not comply with the provisions of these General Terms and Conditions, the organizer is entitled to cancel the tickets or deny the visitor (further) access to the event without the visitor being entitled to reimbursement of the amount he or she directs to the organizer via a pre-sale address for the ticket (including service and / or transaction costs). Holders of such tickets will be denied access to the event without compensation.

4. Arrival / Parking / Camping

4.1. The visitor is responsible for his arrival to the event and parks his car or bicycle at his own risk.

4.2. The organizer provides detailed information on arrival, start of camping, etc. in the festival information, which are available on the website.

4.3. Wild parking is prohibited and will be prosecuted by the authorities; Vehicles may only be parked on approved parking areas or parking lots (partly subject to a charge).

4.4. The visitors undertake to treat the pitch and buildings, facilities, inventory etc. of the camping site with care. Damage caused during the stay by the visitor or his companions must be communicated to the organizer immediately and replaced.

4.5. The organizer expressly points out that irregularities, damages or losses arising from nature (for example tree fruits, insects, animals, branches etc.) can occur; A liability of the organizer for such damage is excluded.

5. Entry control / access to the festival area

5.1. Access to the event is only possible by presenting a valid and undamaged ticket. Persons wishing to attend the event may be asked to provide proof of identity on the basis of the age verification; the card will be exchanged for the ribbon at the festival site. Only visitors with a weekend ticket will be granted re-entry, and only on the condition that they wear a sealed, intact festival ribbon around their wrists. Unlocked or damaged tapes lose their validity. All guests with only 1-day tickets are not allowed to re-enter for safety reasons.

5.2. For security reasons and for the avoidance of waste, a security check is carried out by the security service when entering the event grounds. The Ordnungspersonal / Security is instructed to make a body and pocket visit to the visitors, especially when entering the festival area. The visitors agree with it. The instructions of the Ordnungspersonals / Security is to be obeyed. The organizer reserves the right, in the event of non-compliance, to issue an immediate reference from the event venue.

5.3. The organizer reserves the right to deny a visitor entry to the festival grounds for good cause. As an important reason applies in particular but not exhaustive, the carrying of prohibited items gem. Para. 6, an obvious highly intoxicated state of the visitor when the visitor is obviously under the influence of drugs or has an apparently homophobic, sexist, racist or inhumane attitude. In case of violation of the protection of minors, the admission will also be denied. If there is an important reason for the refusal of admission, the ticket or the festival ribbon will cease to be valid and the entrance fee will not be refunded.

5.4. The organizer reserves the right to refuse, on the festival grounds, visitors who have not obtained the necessary legitimacy in the form of the clause 5.1. mentioned festival volumes, to refer to the entire festival area. A claim for reimbursement of the entrance fee does not exist.

6. Prohibited items

6.1. The entire festival area and the campsite are prohibited:

Glass bottles of all kinds, other glass containers, animals / pets, professional photographic, film and video cameras and tape recorders, drones, laser pointers, aggregates, car batteries, spirits, gasoline or flammable liquids, weapons of all kinds (also in the technical sense), torches, pyrotechnic Objects, dry ice, sparklers, sky lanterns, vuvuzelas, megaphones, commercial, political or religious items of all kinds, including banners, signs, symbols or leaflets, and dangerous objects of any kind.

6.2. The organizer is entitled to temporarily store and take possession of prohibited items.

7. House Rules / Rules of Conduct / Photography and Filming

7.1. The house right is exercised by the organizer as well as commissioned third parties. On the festival grounds, the organizer's house or festival grounds regulations apply. The instructions of the organizer's staff are to be obeyed. Visitors are prohibited from entering the festival grounds:

7.1.1. carry prohibited articles (point 6.1.),

7.1.2. to exercise physical force against other visitors, staff of the organizer or other third parties,

7.1.3. Throw objects on the stage, other visitors or the staff

7.1.4. the "Wall of Death", "Circle Pit" or similar exercise,

7.1.5. to urinate outside the toilets or to do the necessities

7.1.6. painting, spraying or soiling buildings, walls, things etc.,

7.1.7. without the prior written consent of the organizer to trade commercially, to carry out marketing campaigns or advertising. Advertising measures of any kind, i. Applying for a product, service, belief or religion of a business or brand, distributing or presenting political or religious content in any form (such as leaflets, banners, signs, etc.), decorations and other objects prohibited on the entire festival grounds.

7.1.8. To enter areas and rooms that are not released for visitors, and to climb on the stages, tents, trusses or the like.

7.2. Only small-format cameras and mobile phones with camera function are allowed on the event area / in the concert hall. The personal rights of third parties are to be maintained at all times. The production of film or sound recordings of any kind and their publication online or offline without permission of the organizer are prohibited.

7.3. If a visitor commits an offense at the Affection Outdoor Festival (for example, drug trafficking, assault, theft, sexual assault, etc.), the visitor is immediately and without warning warned of the festival site and the matter is reported to the police.

7.4. If there is an important reason mentioned above and the organizer refers the visitor from the venue, the ticket or the festival ribbon will be canceled, the entrance fee will not be refunded. Who culpably violates these terms and conditions, the organizer for the resulting damage is subject to compensation.

8. Cancellation or termination of an event / program changes

8.1. If the Affection Outdoor Festival is canceled, there is a right to a refund of the ticket price without advance booking fee.

8.2. The Affection Outdoor Festival is carried out in all weathers, but should the weather conditions cause danger to life, limb or health for visitors, artists or staff, the Affection Outdoor Festival will be stopped immediately. In this case, as well as cancellation of the Affection Outdoor Festival for other reasons of force majeure, due to official order or court decision, there is no refund or compensation claim, unless the organizer can be charged with intent or gross negligence.

8.3. If due to weather reasons or due to an official order or court decision or due to other unforeseeable circumstances, a performance to be provided by the organizer impossible or delayed (eg labor disputes, breakdowns, transport obstacles, official measures - in each case also with the contractors of the organizer) the organizer reserves the right to cancel the event; a refund of the ticket price is excluded in this case.

8.4. A liability for consequential damages due to the postponement and cancellation of the event is excluded.

8.5. The organizer has no influence on the design, the length and the content of the individual performances and therefore assumes no liability vis-à-vis the visitor.

8.6. A ticket entitles to attend a variety of concerts and accompanying events on the festival grounds. In the case of program changes, the cancellation of individual shows or program items, deletion of individual concerts from the program, including so-called headliners, the visitor therefore has no claims against the organizer, as long as changes remain within a certain limits and preserves the overall character of the Affection Outdoor Festival remains.

Delays and relocations of individual program items are to be accepted by the visitor. The organizer will announce changes without delay at www.facebook.com/affectionfestival/.

9. health impairment by volume

9.1. The organizer is liable for hearing and other health damage only if he and his agents intent or negligence to the load or a duty of care is culpably not fulfilled. The visitor is aware that at the Affection Outdoor Festival, especially in front of the stages a particular volume prevails and the risk of possible damage to health, especially hearing damage exists. The organizer ensures that the visitor is not harmed by the sound level of the performances due to suitable technical equipment, volume limitation and the choice of individual venues. However, regardless of this, it is highly recommended to use earplugs, especially when staying close to the speakers, and to choose a place in front of each stage that will suit your individual listening habits.

10. Protection of minors

10.1. For each event, the provisions of the law on the protection of minors in public apply.

10.2. The entrance to the festival area is permitted from the age of 16.

The entrance to the camping, is also possible from 16, but only in the company of an adult. An adult can take over supervision for a maximum of two minors.

10.3. Persons responsible for education Persons must have written proof of their assignment and, upon request, provide a copy of the identity card of the person entitled to custody.

11. Limitation of Liability

11.1. The organizer, his legal representatives or his vicarious agents are only liable for intent or gross negligence.

11.2. The liability of the organizer for initial impossibility and for the breach of essential contractual obligations, even in the case of ordinary negligence, but limited to the foreseeable and contract-typical damage, remains unaffected by the above limitation of liability. Claims for damages resulting from injury to life, limb or health as well as under the Product Liability Act remain unaffected by the above limitation.

11.3. The organizer is not liable for lost or damaged items. Parking on designated parking lots or the camping area is at your own risk.

12. Right to own picture, picture, video or sound right

12.1. The organizer and third parties commissioned by him are entitled to produce in the context of the events picture, sound and image recordings of the visitors without remuneration for the depicted persons and in every way comprehensively in all known and future media to use or to let use, in particular for reporting in all media, including the Internet, on sound or video recordings, as well as for promoting the Affection Outdoor Festival, for sponsorship acquisition and for all other business activities of the Organizer and its affiliated companies. All rights may also be transferred to third parties for the above purposes.

13. Collecting a deposit

Throughout the festival area, the professional collection of returnable bottles is strictly prohibited and will be prosecuted. To prevent the professional collection of piles at the festival area, a maximum of 10 packages can be exchanged at the bars located there at the same time.

14. Privacy

14.1. The terms of our privacy policy apply.

15. Final provision

15.1. The organizer reserves the right to change the terms and conditions at any time. The amended version will in this case be published on the website. From the date of publication, the changed conditions apply.

15.2. Should any provision of these terms be or become ineffective or unenforceable, this shall not affect the validity of the remaining agreements. In place of the invalid provision, the relevant statutory provisions apply.

15.3. In addition to the present provisions, German law applies to the exclusion of UN sales law.
